In the Name of God, Amen. I Henry Cosby Esqr, Captain of the Centaur Man of War Stationed at the City of New York in America being weak in Body but of sound and perfect mind & memory, do make and publish this my Last Will and Testament in manner following:
Imprimis: I committ my soul into the hands of Almighty God who gave it to me trusting to the mercy of Jesus Christ my Redeemer for Eternal Salvation both of body and soul at the Resurrection of the Just and as to my Worldly Estate I dispose of the same as followeth; Item I will that all my just debts and funeral charges be fully paid and satisfied and for the better doing & performing of the same I do hereby give and grant unto my Executrix hereinafter named free power and authority to sell and dispose of as much of my Real and personal Estate as will fully pay and discharge the same. Item: All of my estate both real and personal whatsoever and wheresoever I do give devise and bequeath unto my dear and loving Mother the Honourable Grace Cosby her heirs and assigns for ever and whom I nominate and appoint my Sole Executrix of this my Last Will and Testament and I desire the favour of the Honourable Joseph Murray Esqr of the City aforesaid my Brother in Law to be aiding and assisting to my said Executrix in the performance & Execution of this my Last Will and Testmant hereby Revoking and making void all former and other Wills by me at any time heretofore made and declaring this to be my Last Will and Testament. In Testimony whereof I the said Henry Cosby have hereunto set my hand and seal this sixth day of October one thousand seven hundred and fifty three. Henry Cosby (Ls)
Signed sealed and declared and Published by the said Henry Cosby as his Last Will and Testament in the presence of us who subscribe our names in the presence of the Testator Peter Renaudet, Sidney Breese, Fran Costigin. Whereas I Henry Cosby have made declared and published my Last Will and Testament in Writing bearing equal date with this codicil. Now I the said Henry Cosby do by this codicil ratifye and confirm my said Last Will and Testament & I do give unto my dear and loving Sister Grace Murray my Gold Watch my diamond Ring and a Diamond Heart which sev'll things my said Sister was pleased to make me a present of some time ago & which I now return to her heirs & assigns, and I do desire and request my said Sister to give unto my Cosn, Phillip Cosby all my wearing linnen and such suits of my wearing cloaths as she shall think proper I also give unto Mr James Stuart Mate of the Centaur Man of War a New Gun & a Bayonet thereunto belonging. My Will and meaning is that this Codicil be and shall be taken as part of my Last Will and Testament In witness whereof I have hereunto set my hand and seal this sixth day of October one thousand seven hundred and fifty three. City of New York, fs: Be it remembered that on the nineteenth day of October one thousand seven hundred and fifty three personally came and appeared before the Honorable James DeLancy Esq.r his Majestys Lieutenant Governour and Commander in Chief in and over the Province of New York and the Territories depending thereon in America Peter Renaudet Surgeon and Sidney Breese Purser of this Majestys Ship Centaur and Francis Costigin of the City of New Brounswick in the Province of New Jersey Attorney at Law the three subscribing witnesses to the within written instruments both bearing date the sixth day of October Instant one of the said Instruments purporting to be the Last Will and Testament of Henry Cosby Esq.r late Captain of his Majesty's sail ship stationed at the City of New York and the other purporting to be a codicil to and part of his said Last Will and Testament and the said Peter Renaudet, Sidney Breese and Francis Costigin being duely sworn on the Holy Evangelists did depose that they and each of them did see the said Henry Cosby Esq'r now deceased sign and seal the said Respective Instuments and heard him publish and declare the same as and for this Last Will and Testament and that at the Respective times thereof he the said Henry Cosby Esq'r was of sound disposing mind and memory to the best of the knowledge and belief of them the Deponents and of either of them and that they the said Deponents did severally subscribe their names as Witnessed to the said two respective Instruments in the presence of the said Henry Cosby Esq'r the Testator. and the Honourable Grace Cosby sole Executrix of the Will of the said Henry Cosby being absent beyond sea and residing in Great Britain as is said therefore let Administration with the Will of the said Henry Cosby annexed be granted unto Joseph Murray Esq/r during the absience of the said Executrix.
